Version: September 28, 2026. This version applies to new contracts into which it is effectively incorporated; existing contracts will not be unilaterally amended. Individual agreements and mandatory law take precedence.

1 Arrival and handover

Entry and key handover: Monday to Friday, 9:00 AM to 6:00 PM, or by prior arrangement. The return time will be agreed upon in the booking confirmation. We are not always on site; unannounced arrivals may result in waiting times. Existing statutory and contractual rights remain unaffected.
Companies will provide all booked personnel with these instructions and the contact number +49 174 3279877 before the start of the trip. Each arriving employee must contact the company immediately after booking by phone or WhatsApp to coordinate their arrival, again directly after departure from the starting point with the expected arrival time, and call approximately one hour before arrival for confirmation. Any delays must be reported immediately.
1.1. Existing damage must be reported in advance.
Any damage noticed on moving in that the landlord had not identified must be reported at that stage. Statutory rights and rules on burden of proof remain unaffected.
1.2 Cleaning and condition upon move-out
The apartments and rooms must be left in a tidy and clean condition (as found!).
Any additional cleaning required will only be charged based on a valid agreement or legal basis and verifiable effort.

2 Availability enquiry, booking and contract formation

The brief availability inquiry is non-binding and does not reserve a room. To make a booking, complete details regarding accommodation, occupancy, contracting party, rental start date, duration, rate, and price are required. An order explicitly marked as a binding booking and including a complete price overview constitutes the booker's contractual offer. The booking becomes binding upon receipt of Pawelkorb's explicit, substantively identical acceptance via email or WhatsApp. An automated confirmation of receipt does not constitute acceptance. As long as essential price or contract details remain unclear, or the form is explicitly designated as an inquiry, no binding order is assumed. A differing confirmation constitutes a new offer and requires the customer's approval. The invoice will then be issued.
A separate booking form with the specific room/property ID must be completed for each guest. This also applies to company bookings and double room bookings. When a double room is booked jointly, the guests and bookings are assigned; the price confirmation shows the total room price and the respective cost distribution. The full room price will not be accidentally charged twice per person. Online availability information is updated as quickly as possible, but does not replace an explicit confirmation.
For corporate bookings, it must be specified whether the company itself is the contracting party or is merely representing another person. The responsible contact person and the residents must be named. Completing this form does not create any personal liability for the contact person, supervisor, or managing director. Separate cost coverage requires an explicit agreement.
For identity verification, presentation of a valid ID may be required upon delivery. Copies of IDs and other documents will only be processed with a legally permissible basis, for a specific purpose, and to the extent necessary. Our privacy policy applies.

2.1 Invoice, handover and subsequent information

Invoicing, Handover, and Early Departure: A valid booking or an already agreed-upon rental/accommodation contract forms the basis for invoicing. Simply sending a new inquiry that has not yet been accepted does not, in itself, establish a claim. If the room has been handed over to fulfill the agreed-upon contract, a voluntary departure shortly thereafter or even on the day of handover does not, in principle, invalidate the agreed-upon rent for the initial booking period or the agreed-upon minimum term. Payment is due according to the valid agreement and mandatory law. Statutory rights of withdrawal, cancellation, termination, and warranty claims, as well as any expenses saved and benefits gained from alternative rentals, remain unaffected. Handover alone does not constitute a blanket waiver of any statutory right of withdrawal.

Already moved in or booked? Private tenants and companies can submit missing or unsent information here – even if the property is "currently occupied." Please provide the actual move-in date and existing booking/invoice number. No second booking, no additional rent, and no retroactive rate changes. New prospective tenants must inquire about availability. Submitting this information documents the existing agreement; the prices and conditions agreed upon remain valid. Billing at current rates does not constitute a retroactive price change.

3 Prices, tariffs and billing

For new room bookings, the following models apply, with no security deposit, customer status requirement, or new customer surcharge. Confirmed contracts will not be changed retroactively. Monthly base price M is the standard rate for the selected room, appropriate for the customer group and occupancy, or an explicitly confirmed special rate. All prices are for the entire room, not per person.
Single room: published individual monthly base price. Double room: Private individuals pay €600 for one person or €660 for two people, including VAT. Companies pay €600 net for one employee or €700 net for two employees, plus VAT. The starting price shown in the overview refers to the standard private monthly rate for one person, including VAT. Occupancy, customer group, and rate can be changed in the price calculator.

Fixed short stay: minimum of 3 billed calendar days. For these three days, a minimum rental fee of €150 applies for the entire room, regardless of room size or permitted occupancy. A stay of only one day or one night is also possible; the minimum rental fee still applies. Private guests: €150 including VAT; companies: €150 net plus VAT, totaling €160.50.

Fixed rate for stays of 4 days or more: Daily rate = M ÷ 30 × factor. Factor 1.80 for 4–6 days, 1.60 for 7–14 days, and 1.50 for 15–29 days. Total rental fee = Daily rate (unrounded values) × Number of days charged, minimum €150. Rounding to the nearest cent is the final total. The minimum rental fee is not an additional charge. Automatic end; no cancellation required.

7 consecutive days: Daily rate M ÷ 30 × 1.45; Rent per 7-day period = M ÷ 30 × 1.45 × 7. Notice period 7 days to the end of the period.

15 consecutive days: Daily rate M ÷ 30 × 1.25 with a 15-day notice period or M ÷ 30 × 1.35 with a 7-day notice period, in each case at the end of the period. Billing and payment per 15-day period.

For continuous 7- and 15-day payment plans, the same contract continues without the need for a new form. If the notice period is as long as the payment period, the cancellation notice for the first payment period must be received no later than the day before the move-in date; otherwise, the contract for the following payment period is already binding. The calculator displays the notice period and payment periods. A payment obligation for the following payment period does not constitute an early due date; payment is made according to the agreed payment schedule.

Monthly, standard: 100% of M with one month’s notice to the end of a month.

Monthly with 14 days' notice to the end of the month: 115 % from M.

Monthly with 14 days' notice to any date: 126.5 % from M.

Monthly with 7 days' notice to any date: 135 % from M. In case of flexible contract end, the last partial month will be billed proportionally.

Fixed monthly rate: M. 140 %. If starting mid-month, the booking includes a pro-rata share of the first month and the full following month; if starting on the first of the month, it includes the full month. Automatic termination at the end of the specified month, no cancellation required, and no automatic renewal.

Room changes are a separate option available only to companies with one employee on a continuous monthly rental basis: €660 net per entire single or double room with one month's notice to the end of the month; €759 net with two weeks' notice to the end of the month; €834.90 net with two weeks' notice to any date; €891 net with seven days' notice to any date. All prices are subject to VAT. Changes are subject to availability and explicit confirmation. Without the room change option, the corresponding fixed room rate applies. The room change option is not offered online for two people.
Each commenced calendar day counts; the start and end days are included. Billing is not based on nights. Fixed daily packages end automatically; extensions require a new explicit agreement subject to availability. Previously booked periods will not be retroactively converted to cheaper weekly or monthly packages. Early departure alone does not terminate an existing contract free of charge. Statutory rights and the crediting of saved expenses or alternative rentals remain unaffected.
The price calculator displays customer group, occupancy, rental model, room change option, cancellation period, and booking period, and is automatically transferred to the booking form. Please make any changes in the calculator first and then reopen the form. Individual special arrangements must be documented with the room name, occupancy, booking period, price basis, amount, services, and our confirmation via email or WhatsApp. Rounded daily rates are provided for comparison purposes; the definitive rates are those calculated to two decimal places.
Standard room preparation, initial handover with fresh linens, and administrative costs are not charged again as damage or cleaning fees. These room rates do not automatically apply to separately offered apartments, houses, or flats. Mandatory statutory rights regarding contract duration and termination remain unaffected; the applicable regulations of the specific contract type apply.

3.1 Calendar months and the first partial month

Monthly rentals are billed according to calendar months, not from the booking date to the same date of the following month. For rentals starting mid-month, the following calculation applies: agreed monthly rate ÷ actual calendar days in that month × number of rental days (or part thereof) up to and including the end of the month. The following month is then automatically booked for at least the entire month. For rentals starting on the first of the month, at least that full calendar month is booked. This minimum term also applies with a shorter notice period and the room change option. Without effective cancellation, the rental continues on a continuous monthly basis.
Example with a €600 monthly rate and a start date of September 27th: €600 ÷ 30 × 4 = €80 for September; then €600 for October. The rent until the earliest regular contract end date of October 31st is €680. With a €660 monthly rate, it's €88 for September plus €660 for October, totaling €748. If the start date is in October, the partial month is divided by 31. With the "Fixed Month" model, the same period is calculated with the monthly rate increased by 40 and ends automatically.
The pro-rata monthly billing is not a short-term booking; daily package surcharges are not applied additionally. The first partial month, the following full month's rent, any remaining fixed period, and the total rent will be shown separately. Agreed-upon additional services will be confirmed separately. No security deposit is required.

3.2 Confirmation, special agreements and VAT

The binding price will be confirmed transparently via email or WhatsApp before the contract is concluded: accommodation, occupancy, rental start date and period, monthly base price, selected tariff, surcharges in percentage and euro, first partial month, ongoing monthly rent, room change option, cancellation option, additional services, and total amount payable. Any deviating agreements must be specified in the form with full details; individually agreed-upon arrangements take precedence. Surcharges or taxes already included in an agreed total price will not be charged again. The calculated amount will be rounded to two decimal places.
For room rentals under this accommodation model, VAT (VAT) applies permanently, even for extended stays and room changes. Private rates are total prices including VAT; corporate rates are net prices plus VAT. The calculator and confirmation show the tax amount and the gross total. Example: €700 net plus €49 VAT equals €749 gross. A private final price of €660 includes €43.18 VAT and remains €660. There is no automatic tax adjustment after six months. Separate additional services are shown with their respective applicable tax rates. This display does not change invoices already issued.

3.3 Security deposit and refrigerator

No security deposit is charged for new room bookings. There is no deposit surcharge or deposit discount. Older agreements already validly confirmed remain unchanged. An additional room refrigerator supplied by us on request costs €20 per month for private and company bookings. This applies only to rooms without an already included refrigerator; shared refrigerators are available in the kitchens. Additional services and their period are confirmed separately.
4 Scope of services
The contractual scope of services for the holiday apartments or the holiday home is determined by the information provided on the website, the booking confirmation or the agreements made, as well as these general terms and conditions.

5 Changes and extensions

Changes to accommodation, occupancy, price, or dates must be explicitly agreed upon and documented via email or WhatsApp for traceability. A legally valid cancellation does not require the landlord's consent; statutory formal requirements remain unaffected.
Fixed short-term bookings have a specific end date, provided that a fixed term is permissible for the specific type of contract. Extensions must be requested before departure and will only be expressly confirmed after availability has been checked, specifying the dates and price. A request alone does not trigger an additional week of payment. For an extension request, the booking number, name, and desired dates are sufficient; unchanged resident information does not need to be fully re-entered. For continuous rates, no new booking is required for each billing period.
A tariff change is only valid from the expressly confirmed change date; until then, the booked tariff remains binding. Early termination of the contract as a gesture of goodwill can be agreed upon in writing in individual cases, specifying the end date, outstanding amounts, and return of the equipment. Without such an agreement, the minimum contract term and notice period apply. Statutory rights remain unaffected.

5.1 Room changes

For each room change, a new form must be completed for each affected person via the link to the desired room. Unauthorized room changes are not permitted. Pawelkorb will confirm the new room, occupancy, change date, price, and billing for the previous room without double charges for the same period. The new form alone does not terminate the existing contract. Statutory rights of termination remain unaffected.
The room change option is selected separately in the calculator with Yes or No; the cancellation option is shown separately. A change of employee within the same company room is not considered a room change and does not automatically activate the change rate.

6 Payment and initial key handover

Rent is payable in advance by bank transfer according to the payment dates specified in the confirmation. Cash payments are not accepted. Amounts for the first partial month and subsequent calendar months will be shown separately. Mandatory statutory payment rights remain unaffected. A different payment agreement for businesses is expressly confirmed.
The invoice issued after the effective conclusion of the contract is payable according to the agreed payment schedule; unless otherwise agreed, the amount due is payable immediately upon receipt of the invoice. All rent payments due up to that point must be received in full before the first handover of keys or codes. Otherwise, Pawelkorb may withhold the initial handover to the extent permitted by law until payment is received. Mandatory statutory payment deadlines, particularly for residential leases, remain unaffected; future rent payments not yet due do not become payable prematurely. The handover entitles the tenant exclusively to use the assigned room and the agreed common areas, not all rooms of the property. Existing possession may not be unilaterally revoked by changing the locks or using a code lock.

7 Termination, non-arrival and payment obligations

Once a booking has been effectively confirmed, there is no additional general right to free cancellation due to a mere change of mind. Contractual termination rights and mandatory statutory rights of withdrawal and cancellation remain unaffected. For accommodation for purposes other than residential purposes for a specific date or period, the statutory exclusion of the right of withdrawal pursuant to Section 312g Paragraph 2 Number 9 of the German Civil Code (BGB) may apply; this is not automatically applied to all residential tenancy agreements.
With the standard monthly lease, the tenant can terminate the lease with one full calendar month's notice to the end of the month: For example, if the notice is received in September, the lease ends on October 31. Private individuals and companies can alternatively choose two weeks' notice to the end of the month (+15 %), two weeks' notice to any date (+26.5 %), or seven days' notice to any date (+35 %) within the monthly lease option. The minimum term specified in section 3.1 also applies in these cases. The "Fixed Month" lease, on the other hand, ends automatically; with "7 Days Continuous," the notice period is seven days to the end of the period, and with "15 Days Continuous," the tenant can choose either 15 or seven days to the end of the 15-day period. These tenant rights do not shorten any mandatory notice periods or legal protections against termination by the landlord. For the termination of residential leases, the legally required written form must be observed; email or WhatsApp alone is not sufficient.
The type of contract is determined by the actual circumstances, not solely by its designation as a short-term or monthly booking. Statutory rights of termination, cancellation, price reduction, and, where applicable, right of withdrawal remain unaffected. In the event of the tenant's personal inability to pay, the payment obligation may continue to the extent provided by law; saved expenses and any creditable benefits from alternative rentals will be taken into account. Double billing for the same period will not occur.
8 replacement tenants
Until the start of the tenancy, any tenant can be replaced by a third party, provided they inform us of this.
However, we may object to the change of tenant if the third party violates legal or official regulations.

9 Damage and liability

Damage and defects must be reported immediately. The parties are liable for damages caused by negligence and for legally attributable conduct by residents or assistants in accordance with statutory regulations. Normal wear and tear is not considered a compensable loss. Claims for compensation will take into account the age and condition of the damaged item. Liability insurance is recommended.
For corporate bookings, payment obligations and liability arise from the confirmed contract, valid separate cost assumptions, and statutory regulations. Statutory warranty rights and the landlord's liability, particularly for injury to life, body, or health, as well as for intent and gross negligence, are not excluded.

10 Termination by the landlord

The landlord may terminate only under validly agreed contractual and statutory conditions. Required warnings, deadlines and form requirements must be observed. These terms do not establish automatic loss of occupancy rights or permit unilateral exclusion from the room.
11 General Obligations
The maximum number of people specified for the holiday apartments/houses must not be exceeded. Additional guests may be refused entry. Exceptions may be arranged in individual cases. Otherwise, we reserve the right to charge an additional fee for any extra guests.
All guests are required to comply with the house rules. Violations will be subject to the applicable legal consequences, as well as any legally binding agreements; a blanket exclusion of refund claims is not permitted.

11.1 Clean handover, inventory and damage reporting

We hand over the rooms cleaned, with fresh bed linen and functioning equipment; any known discrepancies are documented. Upon arrival, tenants should inspect the condition and the provided furnishings, especially furniture, bed linen, dishes, cutlery, and cookware, together with us using the inventory list. Any visible damage, soiling, or missing items should be reported immediately in the handover protocol, ideally with photos. Defects discovered later must be reported immediately upon discovery. Failure to report a defect does not automatically constitute proof of a defect-free move-in or of the tenant's fault; statutory rules of evidence remain unaffected.
In the event of attributable damage, loss, or exceptional soiling, we may charge necessary and reasonable repair, cleaning, renovation, or replacement costs in accordance with a valid agreement and statutory liability. The condition, cause, and costs will be documented transparently; age, current value, normal wear and tear, and a necessary deduction for "new for old" will be taken into account. For corporate bookings, the invoice will be addressed to the contractually obligated company, insofar as its liability applies. A contact person is not personally liable solely for the execution of the booking. Standard room cleaning already included will not be charged twice.
Keys and access codes must not be given to unauthorized persons. Report any losses immediately; return all keys upon moving out. House rules, consideration for others, proper waste separation, and cleanliness must be observed.

12 Applicable law and jurisdiction

German law applies, while mandatory consumer-protection provisions are preserved. Jurisdiction is determined by statutory provisions.
13 Severability Clause
The invalidity of individual provisions of the lease agreement does not result in the invalidity of the entire lease agreement.
14 printing errors
Any identifiable errors will be clarified before the contract is concluded. After the contract is concluded, corrections are governed by the agreement and legal regulations; this does not create a unilateral right to change the price.
Pawelkorb GmbH // Haren (Ems)

AGB Pawelkorb – Vermietung von Wohnobjekten Allgemeine Geschäftsbedingungen (Vertragsbedingungen)Die Allgemeinen Vertragsbedingungen, die bei der Buchung/ Bezug der Wohnung von Ihnen anerkannt werden, Regeln die Rechtsbeziehungen zwischen Ihnen und Pawelkorb GmbH, – Heinrichstraße 89 A, 49733 Haren (Ems).Lesen Sie diese deshalb bitte sorgfältig durch.
